Terms & Conditions – Better Bin Hire Geelong
1. General By booking, accepting a quote, making payment for, receiving or using a bin supplied by Better Bin Hire Geelong, the customer acknowledges and agrees to these Terms & Conditions. These Terms & Conditions apply to bookings made online, by telephone, email, in person or through an authorised employee, representative, contractor or site contact of the customer.
2. Hire Period * Standard hire is 7 days, unless otherwise agreed at the time of booking. * Extended hire is charged at $20.00 per day, unless otherwise agreed in writing. * Customers must notify Better Bin Hire Geelong when the bin is ready for collection. * Additional hire charges may continue to apply until the bin is collected or a collection has been arranged.
3. Bin Placement & Access The customer is responsible for ensuring there is suitable and safe access for delivery, changeover and collection of the bin. Clear access must be maintained at all times. The customer is responsible for selecting or approving the location in which the bin is placed. Better Bin Hire Geelong accepts no responsibility for damage to driveways, concrete, paving, lawns, landscaping, underground services or other property where the customer has requested or authorised the bin or truck to enter or be positioned, except to the extent liability cannot lawfully be excluded. Additional charges may apply where a delivery or collection cannot be completed due to inadequate access, obstructions, an overloaded bin or circumstances within the customer’s control.
4. Weight Allowances & Excess Weight Each bin has a specified weight allowance. The applicable allowance will be advised at the time of booking and/or stated on the customer’s quote or invoice. The weight allowance is an allowance only and is not an estimate or guarantee of what the customer’s waste will weigh. Customers are responsible for the type and quantity of material placed in the bin. The final weight of the waste is determined when the bin is weighed at the disposal facility/weighbridge. Better Bin Hire Geelong cannot accurately determine the final weight of a loaded bin prior to disposal. Any weight exceeding the included allowance will incur an excess weight charge at the rate disclosed on the customer’s quote or booking. Where an excess weight charge is invoiced, Better Bin Hire Geelong may provide the applicable disposal/weighbridge record as evidence of the recorded weight upon reasonable request. Materials including, but not limited to, carpet, timber, plaster products, tiles, bricks, concrete, soil and other dense construction or demolition materials can substantially increase the weight of a bin. It is the customer’s responsibility to consider the weight of the materials being disposed of when selecting a bin and waste type. Advice provided by Better Bin Hire Geelong regarding an appropriate bin size or likely weight is based on information supplied by the customer and is an estimate only.
5. Overfilled Bins Bins must not be filled above the top rim. Waste must be contained safely within the bin and must not protrude from the sides or top. Better Bin Hire Geelong may refuse to transport an unsafe or overloaded bin until the customer has removed or rearranged the material. Any additional attendance, waiting time or return trip required as a result may incur an additional charge.
6. Acceptable & Prohibited Waste Customers must only place waste in the bin that is permitted for the waste type booked. Prohibited items include, but are not limited to: * Asbestos or suspected asbestos-containing material * Hazardous waste * Chemicals or liquids * Wet paint and oils * * Gas bottles * Fire extinguishers * Concrete dust * Food waste where not specifically permitted * Any other material prohibited by the applicable disposal facility Tyres and mattresses may only be disposed of where accepted by Better Bin Hire Geelong and will incur the applicable additional charge advised at the time of booking or stated on the quote. If incorrect, contaminated or prohibited material is found in a bin, Better Bin Hire Geelong may refuse collection, return the material where lawful and reasonably practicable, or charge the customer any additional disposal, handling, transport or other costs reasonably incurred.
7. Customer Responsibility for Bin Contents The customer is responsible for all material placed in the bin during the hire period, including material placed in the bin by employees, contractors, neighbours, members of the public or any other third party. Better Bin Hire Geelong is not responsible for unauthorised use of the bin by third parties while the bin is in the customer’s possession or at the nominated site. The customer is responsible for ensuring the bin is used in accordance with the waste type booked and these Terms & Conditions.
8. Responsibility for the Bin The customer is responsible for the bin from delivery until collection. The bin must not be moved from the location in which it was placed by Better Bin Hire Geelong without prior approval. Any loss, theft, deliberate damage, fire damage or misuse of the bin may result in the customer being charged the reasonable cost of repair or replacement. Fires must not be lit in any bin.
9. Permits Where a bin is to be placed on a road, nature strip or other public property, any required council or authority approval must be obtained. Unless Better Bin Hire Geelong has specifically agreed to arrange the permit, obtaining and complying with the permit is the customer’s responsibility. Any fines, penalties or costs arising from the customer’s failure to obtain the necessary approval may be charged to the customer to the extent permitted by law.
10. Delivery, Changeovers & Collection Requested delivery, changeover and collection times are estimates only. Better Bin Hire Geelong will make reasonable efforts to accommodate requested dates and times but cannot guarantee an exact delivery or collection time. Delays may occur due to traffic, disposal facility delays, weather, vehicle availability, previous jobs, access issues or other circumstances outside our reasonable control.
11. Payment & Additional Charges Payment is required in accordance with the terms agreed at the time of booking. New customers may be required to pay in full prior to delivery. Additional charges may include, where applicable: * Excess weight * Extended hire * Incorrect or contaminated waste * Prohibited items * Mattresses and tyres * Failed delivery or collection attempts * Additional transport or disposal charges caused by the customer’s waste or actions * Damage to or loss of the bin Additional charges identified after collection or disposal may be invoiced separately and are payable in accordance with the payment terms shown on the invoice. Failure to pay an amount when due may result in recovery action and the customer may be responsible for reasonable debt recovery costs to the extent permitted by law.
12. Quotes & Authorised Bookings Quotes are based on the information supplied by the customer at the time of enquiry. If the waste type, quantity, weight, site conditions, hire period or other relevant circumstances differ from the information supplied, additional charges may apply. Where the customer is a business or organisation, instructions provided by its employees, site supervisors, contractors or other persons reasonably appearing to have authority to arrange bins, collections or changeovers may be treated as authorised instructions.
13. Cancellations Cancellations must be made before the bin has been dispatched. A reasonable cancellation or transport charge may apply where a truck or bin has already been dispatched or costs have already been incurred.
14. Safety Customers must: * Not move the bin once positioned without approval. * Not light fires in the bin. * Not overload or overfill the bin. * Ensure the bin is loaded safely. * Ensure the contents are suitable for the waste type booked. * Maintain safe and adequate access for collection.
15. Liability To the extent permitted by law, Better Bin Hire Geelong is not responsible for loss, damage or injury arising from misuse of the bin, unsuitable placement requested by the customer, prohibited waste, overloading, unauthorised movement of the bin or failure to comply with these Terms & Conditions. Nothing in these Terms & Conditions excludes, restricts or modifies any right or guarantee that cannot lawfully be excluded under the Australian Consumer Law.
16. Acceptance By accepting a quote, placing an order, making payment, requesting delivery or changeover, or otherwise proceeding with the hire, the customer acknowledges that they have had the opportunity to review and agree to these Terms & Conditions.
